YouTuber Dhruv Rathee Summoned by Delhi Court Over Defamation Suit Filed by BJP Spokesperson

A case of defamation was filed by the BJP’s Suresh Nakhua against Dhruv Rathee and the Delhi court has issued summons to Rathee today. 

YouTuber Dhruv Rathee Faces Defamation Lawsuit, Summon Issued by Saket Court Delhi for Defaming Suresh Karamshi Nakhua, a BJP Spokesperson of Mumbai. Nakhua says Rathee has called him a violent and abusive troll in a recent video. 

District Judge Gunjan Gupta, on July 19, 2024, tied the summons and a notice of application under Order 39, Rules 1 and 2 of CPC to Dhruv Rathee, and other social media intermediaries. The date for the hearing of the case is August 6, 2024. Joining now for Pleadings is Advocate Raghav Awasthi and Advocate Mukesh Sharma for the side of Nakhua. 

The Accusations 

This defamation lawsuit arose from a video Rathee posted on the 7th of July 2024 entitled ‘My Reply to Godi Youtubers | Elvish Yadav | Dhruv Rathee. ‘ The video currently has garnered over 24 million views and 2.3 million likes since the video was released. 

In the video, Rathee alleged that, PM Narendra Modi has entertained violent and abusive trolls including ankit jain suresh nakhua & tajinder bagga at his official residence. Nakhua says that such comments have painted him a wrong image as a violent person, which has greatly affected his image.

Plaintiff’s Assertions 

Suresh Karamshi Nakhua has claimed that Rathee’s video has caused harm to his personal as well as professional life. He mentioned also that due to the fictitious allegations, which called for everyone’s disdain and mockery, he lost all his reputation which cannot be regained. 

 Nakhua avers that Rathee continues to argue that the video he uploaded was quite provocative and inflammatory, going viral on social media. He holds the opinion that it was created with the explicit purpose of linking him to negative and abusive trolling activities while having no proof. 

 Legal Developments 

 Issuance of the summons and the notice of application bring closer and focus on the allegations to Rathee and the severity of it as well as the consequences that may accompany it. The trial is grand total set for August 6, 2024, in this trial both sides are permitted to bring in and present to the court any evidence and or arguments that they wish.
